In accordance with the implementation of land registration as mandated by Law No. 5 of 1960 on the Basic Provisions on Agrarian (“UUPA“) and Government Regulation No. 24 of 1997 on Land Registration (“GR 24/1997“), on 2 March 2016 the Ministry of Agricultural and Spatial Planning as Chairman of National Land Agency promulgated a new regulation  on the Amendment of the Form and Content of Certificate of Right of Land. (“Permen No. 7/2016”).

Permen No. 7/2016 was intended to conform to the legal development, technology and community needs with respect to some of the procedures related to land registration and the issuance of land certificates.

Land Registration System Through the Computerization of Land Activity

Permen No. 7/2016 stipulates that the registration of land to be performed with the new Computerization system of Land Activity (“KPP”). The KPP is the new electronic system in a systemized and integrated application which can be performed with or without network and also can be directly synchronized automatically. The registration of the land can only be performed manually if there are any technical disturbances such as blackouts, disrupted internet network, or if the system is down. Each land office will be given a maximum period of 2 (two) years since 2 March 2016 to change its registration system from manual to become KPP.

Alteration of Form and Content of the Certificates of Right of Land

The certificate will be printed in 1 (one) sheet based on information obtained from the physical and juridical data. The size of the certificate itself will be larger than the previous format of the certificate, with the height of 35.5 cm and width of 21.5 cm. Therefore, it is possible so  that all information about the certificate be printed in one page. Each certificate for individuals will also attach a photo of the holder of right of land. The certificate of  right of land contains information about:

  1. the name of the holder of right of land;
  2. types of right of land;
  3. ID number of the land;
  4. the national identification number / identity number;
  5. the date of the rights ended for land rights with a period;
  6. citations map registration;
  7. publishing date; and
  8. Endorsement

All records, encumbrance of other rights, responsibilities or restrictions will also be included in the certificate.

Nevertheless, certificate which was made with the form, content and format prior to the enactment of this Permen No. 7/2016 remains valid and enforceable. As for the old forms of certificates of land that are still available at the land office may still be used until the supplies are depleted.
