Introduction
Regulation No. 2 is issued on the year 2015 by The Minister of Agrarian Affairs or the Head of National Land Agency. This regulation is about the standards of management and services for land affairs of capital investment activities, spatial planning, and agrarian. This regulation is also known as Permenag No. 2/2015. It is considered as implementing regulation for Presidential Regulation No. 97 that is issued in 2014 about implementation of integrated services.
This regulation is basically ordering the requirements, type of service, time frame, cost, and procedures that are used to provide arrangement and service performance on agrarian, land affairs of capital investment activities, and spatial panning.
Based on Permenag No. 2/2015, the service provider is the Minister of Agrarian Affairs or the Head of National Land Agency, City Office, and Regional Office.
Types of Integrated Services
There are several types of integrated services (PTSP) that are regulated in Permenag No. 2/2015. These types of integrated services are including:
- Information about land availability;
- Technical considerations that are related with land affairs;
- The land plots’ measurements;
- Specifications of land rights;
- Registration of the verdict of land rights;
- Customer service.
The Procedures and Process of PTSP
The PTSP is regulated under certain procedures. The procedures that are applied for PTSP are explained below.
- First, the applicants should submit document of application that are provided with the documents of land affairs. The applicants also need to provide other documents that are related to the affair as well.
- If the applicants can not completed the documents that are required for application as explained in the point above, the competent authority has right to return the documents of application to the applicants. The applicants will be required to complete the documents based on the requirements.
- The PTSP is considered completed when the applicants have completed the document of application and submit the documents to the competent authority. PTSP is also considered completed when the applicants have paid the cost that is required for PTSP procedures. However, this condition will be not applied for land affairs’ application where there is conflict, dispute, case, or any other legal issues that are involved. If there is any other legal issues that are involved, the application can be rejected by the competent authority and the competent authority can return the document to the applicants.
The Result and Report of PTSP Implementation
The Minister of Agrarian Affairs or the Head of the National Land Agency or the Head of Regional Office or the Head of City Office of Minister of Agrarian Affairs acts as the competent authorities in implementing the PTSP. As the competent authorities, the Minister of Agrarian Affairs or other authorities that are mentioned above has responsibility to provide the PTSP implementation reports that are given to the Minister of Agrarian Affairs or the Head of the National Land Agency. The reports that are submitted contain details as below:
- Report that is issued by the officer or competent authority of Minister for Agrarian Affairs of the Head of the National Land Agency is provided and submitted regularly every six months.
- Report that is issued by the Head of City Office of Minister for Agrarian Affairs or the Head of the National Land Agency is provided and submitted regularly every month.
