Background
Minister of Agrarian and Spatial Planning/Head of National Land Agency enacted the Minister Regulation No. 14 of 2017 regarding Procedures on Extinguishment of Mortgage Rights over the Land and Objects related to the Land Documents (“Minister Regulation No. 14/2017”), which came into force since 15 August 2017.
Extinguishment of Mortgage Right Documents
Document of the mortgage rights (“MR”) is temporary document where its use is valid until the MR record has been deleted (roya). Thus, MR document is not included in the category of land registration filing.
The MR document means deed of Land Conveyancing Officer or minutes of auction related to the mortgage right object.
The extinguishment of MR document is made in the form of Minutes of Extinguishment of Mortgage Rights Documents. The Head of the Land Office shall make a list of destroyed documents of MR annually.
This Permenag No. 14/2017 revokes
the provision concerning MR documents or rights encumbrance on Regulation of Head of National Land Agency No. 8 of 2009 on the Official Document and Filing of the National Land Agency.
